PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of the treats hq inc. website agree that accessing and using this site is subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

Product Disclaimer
The products available on this site include components which may cause undesired effects if fitted to your vehicle without necessary expertise, or fitted in contravention to the vehicles specifications, or modify the vehicle's specification outside of legal requirements. Please note that use of such products is at your sole risk, and that you assume full responsibility for any and all results of usage, and complying with the vehicle legal requirements in your locality, state or country. We highly recommend using a professionally qualified mechanic to install replacement parts. All performance parts are strictly for off road/track use only.

Product Warranties

treats hq inc. makes no warranty as to the products it distributes, express or implied, including without limitation any warranties of merchantability or fitness for a particular purpose. However treats hq inc. will pass on any and all warranties made by the original manufacturer, who has the sole responsibility for performing any such warranties. The manufacturer shall be solely responsible for any damages to person or property arising from the design, manufacture, and testing of its products. treats hq inc. shall not be liable for any direct, incidental, or consequential damages as a result of any manufacturer's breach of its warranty.

Typographical Errors
In the event that a treats hq inc. product is mistakenly listed at an incorrect price, treats hq inc. reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. treats hq inc. reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, treats hq inc. shall issue a credit to your credit card account in the amount of the incorrect price.

Termination
These terms and conditions are applicable to you upon your accessing your account, the treatland web site and/or completing the transaction or shopping process. These terms and conditions, or any part of them, may be terminated by treats hq inc. without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Notice
treats hq inc. may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to treats hq inc.

Miscellaneous
This agreement shall be governed in all respects by the laws of the state of California, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of a transaction with treats hq inc., including the purchase of treats hq inc. products, shall be in the state or federal courts located in the city of San Francisco, California. Any cause of action or claim you may have with respect to the purchase of treats hq inc products must be commenced within one (1) year after the claim or cause of action arises. treats hq inc.'s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. treats hq inc. may assign its rights and duties under this Agreement to any party at any time without notice to you.

Third-Party Links
In an attempt to provide increased value to our visitors, treats hq inc. may link to sites operated by third parties. However, even if the third party is affiliated with treats hq inc., treats hq inc. has no control over these linked sites, all of which have separate privacy and data collection practices, independent of treats hq inc. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, treats hq inc. seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to including specific links that do not work.

Payment Terms
Terms of payment shall be determined at treats hq inc. sole discretion. Payment for Items shall be made by PayPal, American Express, VISA, Mastercard, or Discover Card. Credit card payments are subject to the approval of the financial institution issuing your credit card, and treats hq inc. shall not be liable in any way if such financial institution refuses to accept or honor the credit card for any reason. By prior arrangement and at treats hq inc. sole discretion we will also accept Money Orders, Bank Drafts, UPS COD and Personal Checks. We accept cash if you pick up goods ordered online.

Sales Tax
treats hq inc. is obligated to withhold sales tax for delivery of goods and services to addresses within various states. Unless you provide treats hq inc. with a valid tax exemption or resale certificate prior to treats hq inc. processing of the order, you are responsible for sales and all other taxes associated with the order.

Force Majeure
treats hq inc. shall not be liable for loss or damage caused by any delay or failure to perform its obligations under these terms caused by failure of any machine, system of authorization, data processing or communications system, transmission link, strikes, lockouts, riots, war, fire, acts of God, accidents, material or transportation shortages, governmental restrictions or injunctions, or denial of import or export licenses, or compliance with any law, regulation or order, or due to any other circumstances or causes that have the effect of frustrating performance of these Terms, or any other cause beyond the control of treats hq inc.

Shipping
All items offered are in stock and shipped as fast as possible usually within 24 hours of payment. If you want faster shipping, you may select USPS priority mail or express mail and pay the rates quoted by USPS. All shipments are insured for the total value of the shipment and responsibility for loss or damage during shipment passes onto you and the carrier once the carrier has picked up the package from our premises.

Returns & Refunds
All returns and refunds are handled on a case by case basis. there is a 60 day limit to any returns being made. Any shipping and handling fees related to returned merchandise is the responsibility of the buyer. If you would like to return an item or get a refund please email us at [email protected] to obtain an RMA (Return Authorization) number. No returns are accepted without the RMA number.
